PERLINDUNGAN HUKUM TERHADAP PEMENANG LELANG ATAS PEMBLOKIRAN SERTIFIKAT HAK MILIK SEHINGGA BALIK NAMA TIDAK DAPAT DIPROSES (STUDI KASUS PUTUSAN NOMOR 151/PDT/2019/PT.BTN)

Abstract

The auction winner has legal certainty over the auction goods he bought based on the minutes of the auction, and has the right to register his land rights with the National Land Agency in the context of changing the name from the old owner to the new owner, then the ownership rights are transferred completely to the auction winner. This thesis uses a normative legal research method (library) to get a conclusion, namely the legal consequences for the auction winner through the execution of mortgages who cannot own the object of the auction, namely they cannot transfer names and register land to the National Land Agency. Legal protection to the auction winner through the execution of mortgage rights who cannot own the object of the auction through a lawsuit and can file a lawsuit against the law (PMH) to cancel the block by attaching a Court Decision to the National Land Agency.
